EU signs ACTA, global internet censorship treaty

Today, the European Union and 22 member states signed the Anti-Counterfeiting Trade Agreement (ACTA), Japan’s Ministry of Foreign Affairs announced. They have now joined the US and seven other nations that signed the treaty last October.

This signing ceremony merely formalized the EU’s adoption of ACTA last month, during a completely unrelated meeting on agriculture and fisheries, reports TechDirt.

Though initiated by the US, Japan is the official depository of the treaty.

Removal of the Three Strikes clause, in which users accused of three counts of piracy would be barred from the internet, paved the way for the EU to adopt ACTA last month.

Related to ACTA, a chapter in the Trans Pacific Partnership Agreement (TPP) “would have state signatories adopt even more restrictive copyright measures than ACTA,” reports the Electronic Frontier Foundation.

Both ACTA and TPP were developed without public input and outside international trade groups, like the World Trade Organization and the Organization for Economic Cooperation and Development.

Leaked cables published by WikiLeaks in 2009 exposed early drafts of ACTA, resulting in a firestorm of controversy. Those cables, coupled with later releases, showed that ACTA negotiationsbegan in 2006 and were controversial even to participating states.  An historical summary of the treaty’s progress through December can be found here.

ACTA Violates Magna Carta and US Constitution

Like PIPA and SOPA, two domestic internet censorship bills that prompted major websites to blacken their name or website in a Jan. 18th protest, ACTA allows accusers of copyright infringement to bypass judicial review.  Lack of “due process” makes these bills and ACTA unconstitutional and violates the Magna Carta, a charter signed in 1215 on which most Western law is based, including the US Constitution.  It is often cited as the most important legal document in the history of democracy.

(The USA PATRIOT Acts, Obama’s assassination program, and the National Defense Authorization Act that allows indefinite detention are among many recent laws passed in the US which directly breach the Magna Carta.)

“The Constitution states only one command twice,” explains Peter Strauss of Cornell University Law School, further elaborating:

The Fifth Amendment says to the federal government that no one shall be ‘deprived of life, liberty or property without due process of law.’ The Fourteenth Amendment, ratified in 1868, uses the same eleven words, called the Due Process Clause, to describe a legal obligation of all states. These words have as their central promise an assurance that all levels of American government must operate within the law (‘legality’) and provide fair procedures.
Not only due process, but US adoption of ACTA also violates Article II, Section 2 of the U.S. Constitution, which provides that the president “shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two-thirds of the Senators present concur.”

The Senate never voted on ACTA.

During the Jan. 18 internet blackout, Darrell Issa (R-CA) introduced OPEN, (H.R. 3782, the Online Protection and Enforcement of Digital Trade Act).  Heather Callaghanpoints out that even though OPEN targets foreign-based websites,

[T]he bill’s wording is wide open to pursue American sites. Just one example: when describing an infringing site, it starts with those ‘that are accessed through a non-domestic domain name,’ but continues in section (8)(A)(ii) for any site that ‘conducts business directed to residents of the United States.’

As this slew of internet censorship bills and treaties make their way into law, “the United States fell 27 places on the Reporters Without Borders tenth annual Press Freedom Index of 2011 to 47th overall,” reports Activist Post.

Today’s signatories included the EU, Austria, Belgium, Bulgaria, Czech Republic, Denmark, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxemburg, Malta, Poland, Portugal, Romania, Slovenia, Spain, Sweden and the United Kingdom.

Last October, Australia, Canada, Japan, South Korea, Morocco, New Zealand, Singapore and the United States signed ACTA.

Though involved in early ACTA negotiations, Switzerland and Mexico have not yet ratified it.  However, “Since the agreement remains open to signature until May 2013, it is possible that other states may make a move to join it as well,” said Maira Sutton of EFF.

India to pay gold instead of dollars for Iranian oil

India is the first buyer of Iranian oil to agree to pay for its purchases in gold instead of the US dollar, DEBKAfile’s intelligence and Iranian sources report exclusively. Those sources expect China to follow suit. India and China take about one million barrels per day, or 40 percent of Iran’s total exports of 2.5 million bpd. Both are superpowers in terms of gold assets.

By trading in gold, New Delhi and Beijing enable Tehran to bypass the upcoming freeze on its central bank’s assets and the oil embargo which the European Union’s foreign ministers agreed to impose Monday, Jan. 23. The EU currently buys around 20 percent of Iran’s oil exports.

The vast sums involved in these transactions are expected, furthermore, to boost the price of gold and depress the value of the dollar on world markets.
Iran’s second largest customer after China, India purchases around $12 billion a year’s worth of Iranian crude, or about 12 percent of its consumption. Delhi is to execute its transactions, according to our sources, through two state-owned banks: the Calcutta-based UCO Bank, whose board of directors is made up of Indian government and Reserve Bank of India representatives; and Halk Bankasi (Peoples Bank), Turkey’s seventh largest bank which is owned by the government.
An Indian delegation visited Tehran last week to discuss payment options in view of the new sanctions. The two sides were reported to have agreed that payment for the oil purchased would be partly in yen and partly in rupees. The switch to gold was kept dark.

India thus joins China in opting out of the US-led European sanctions against Iran’s international oil and financial business. Turkey announced publicly last week that it would not adhere to any sanctions against Iran’s nuclear program unless they were imposed by the United Nations Security Council.
The EU decision of Monday banned the signing of new oil contracts with Iran at once, while phasing out existing transactions by July 1, 2012, when the European embargo, like the measure enforced by the United States, becomes total. The European foreign ministers also approved a freeze on the assets of the Central Bank of Iran which handles all the country’s oil transactions.
However, the damage those sanctions cause the Iranian economy will be substantially cushioned by the oil deals to be channeled through Turkish and Indian state banks.  China for its part has declared its opposition to sanctions against Iran.

DEBKAfile’s intelligence sources disclose that Tehran has set up alternative financial mechanisms with China and Russia for getting paid for its oil in currencies other than US dollars. Both Beijing and Moscow are keeping the workings of those mechanisms top secret.

Monsanto: ‘There is no need for, or value in testing the safety of GM foods in humans’

There is a growing body of scientific evidence which proves that genetically-modified organisms (GMOs) are inherently different from natural organisms, including the way the body processes them, as well as how the immune system responds to them. But Monsanto, the largest purveyor of GMOs in the world, believes that GMOs are no different than natural organisms, and that GMO testing is both needless and valueless.

In theWhy aren’t you running human clinical trials on GM crops?section of Monsanto’sFood Safetypage, the biotechnology giant explains its opinion that GMOs are “substantially equivalent” to natural organisms. According to Monsanto, since concentrations of proteins, carbohydrates, and other nutrient factors vary among natural crops, as well as among natural and GM crops, then these differences are automatically unimportant in light of GMO safety.

Furthermore, Monsanto claims that its injection of foreign DNA into its GM crops is also automatically safe because, get this, DNA is present in natural crops as well. Never mind that the injected DNA is foreign and unnatural, and is used to alter the entire genetic structure of GM crops — according to Monsanto, its unnatural DNA is automatically non-toxic because every other plant also has DNA. Case closed.

Using this same absurd illogic, injecting foreign animal DNA into a developing human baby, for instance, must also be safe because that baby contains DNA, right? Or how about drinking antifreeze, which is made of atoms, because your body is also made of atoms? Based on Monsanto’s pseudoscientific nonsense,everythingcan be considered non-toxic and safe because it is all made of atoms, just like our bodies!

Foreign DNA in GMOs responsible for disease-causing inflammation, autoimmune disorders

Concerning the injection of foreign DNA into GM crops, Physicians and Scientists for Responsible Application of Science and Technology (PSRAST) have taken a more scientific approach by actually investigating how the body processes foreign DNA, which revealed that things are not as peachy as Monsanto claims they are. As can be expected, foreign DNA is not properly recognized by the body, and negatively stimulates the immune system in such a way as to cause disease-inducing inflammation (http://www.saynotogmos.org/scientific_studies.htm).

Monsanto does not actually care about science, though, and has actually made it a point to just arbitrarily deny the need for actual GMO testing in humans to prove its claims. In concluding its unsubstantiated diatribe about why human testing of GMOs is unnecessary, the agri-giant says there is simply “no need, or value” in testing the safety of GMOs — in other words, if Monsanto says they are safe, then they are safe!

The fact that anyone considers this blind, self-serving declaration to be scientifically sound is frightening in and of itself, let alone the fact that the US government openly approves of such nonsense and has used it to form food policy. To put it more simply, GMOs have never been properly safety tested in humans because Monsanto does not feel it is necessary, and most of those in control of food policy are perfectly content with this.

Iran has reacted angrily to an agreement by European Union foreign ministers to impose an oil embargo on the country.

Following the agreement reached on Monday, Iranian lawmaker Mohammad Ismail Kowsari, deputy head of Iran’s influential committee on national security, said the strait “would definitely be closed if the sale of Iranian oil is violated in any way.”

A fifth of the world’s oil moves through the Strait of Hormuz.

“Tehran will not grin and bear it when its interests are undermined,” said lawmaker Alaeddin Boroujerdi, according to Press TV. Boroujerdi is a lawmaker who heads the national security and foreign policy committee in Tehran.

Another lawmaker, Heshmatollah Falahatpisheh, said Iran has a “right” to shut down Hormuz. Falahatpisheh is a senior member of Iran’s Majlis, or Iranian parliament.

Ali Falahaian, a former intelligence minister, said Iran should stop all its crude exports “so that oil prices would go up and the Europeans’ sanctions would collapse.”

Iran first issued warnings about closing down the Strait of Hormuz in December. “If they impose sanctions on Iran’s oil exports, then even one drop of oil cannot flow from the Strait of Hormuz,” said Vice President Mohamed Reza Rahimi.

Admiral Habibollah Sayyari told Iran’s state-run Press TV that closing down the strait would be “very easy for Iranian naval forces,” but said “such a decision should be made by top establishment leaders.”

It now appears Iran’s leaders are a step closer to considering that option as the EU and the United States impose an embargo and punitive sanctions.

The price of oil surpassed $99 per barrel on news of the embargo and Iran’s response.

Benchmark crude for March delivery moved up about a dollar to trade 90 cents higher at $99.23 a barrel in electronic trading on the New York Mercantile Exchange, according to the Associated Press.

There’s something very odd about GOP primary pre-polling and vote

Okay.  It’s time somebody says it. Something seems very strange about the GOP primary pre-polling and vote thus far.

As a Ron Paul fan, I didn’t want to seem like a sore loser after the odd Iowa result where the failed no-name Senator, Rick Santorum, was catapulted to victory with very little tangible support.

But now, how on earth could Newt Gingrich win the South Carolina primary when the day before the vote he had to cancel a major campaign stop because of lack of attendance?

The Associated Press reported:

Newt Gingrich has cancelled a campaign appearance in South Carolina because of poor attendance.

The Republican presidential candidate was scheduled to speak to the Southern Republican Leadership on Friday. But a campaign spokesman told reporters that he would no longer be appearing due to poor attendance.

There were just a few dozen people in the audience at the College of Charleston’s arena, where the event was taking place.

Meanwhile, on the same day Ron Paul boasted over 1000 attendees at his campaign event in Charleston:

2012 Republican Presidential candidate Ron Paul attracted more than 1,000 supporters in Charleston today, demonstrating his strong support among younger voters and his overall popularity.

The crowd gathered expressly for the 12-term Congressman from Texas as he participated in “The Bully Pulpit Series” at 11:00 a.m. EST at the College of Charleston, located at 7 College Way, Charleston. The candidate had been in Washington the day prior for a key House vote against President Obama raising the debt ceiling, but upon his return there was apparently no loss of enthusiasm.

Primary elections are traditionally driven by enthusiasm.  In other words, the average voter does not turn out for primaries unless they are motivated by a certain candidate. So, could someone please explain to me how Newt Gingrich, who has virtually no ground game, no money, and no fervent supporters, just won the South Carolina primary?

Could the conspiracy to keep Ron Paul out of the Oval Office be this coordinated, this pervasive?

Google Is Already Using SOPA-Like Censorship

Web giant blacklists websites, follows government orders to remove material

Despite Google’s much-heralded support for the anti-SOPA movement, the web giant is already enforcing SOPA-like policies of its own, blacklisting legitimate websites from its news aggregator and following government orders to remove material from its search results and You Tube.


As major Internet giants joined forces yesterday to protest legislation that would hand the U.S. government power to arbitrarily seize websites with no legal process under the pretext of copyright infringement, Google slapped a black censorship image over its logo and urged people to sign an anti-SOPA petition that has accrued over 5 million signees.

However, Google’s main issue with SOPA is seemingly not related to their concerns about Chinese-style web censorship becoming commonplace, but rather which entity gets to wield those powers – large transnational corporations or governments.

While Google criticizes SOPA publicly, it is already privately using SOPA-like powers to unfairly marginalize legitimate web content.

Google News is a content aggregator that allows users to search thousands of news sources for relevant stories. Although the aggregator includes a plethora of obscure, occasionally offensive, and barely-read websites, in November 2010 Google took the decision to de-list PrisonPlanet.com and Infowars.com from its indexed news sources.

Infowars.com alone is an internationally recognized news website that gets more traffic than MSNBC.com and innumerable other big mainstream news websites. Our articles are routinely featured on the Drudge Report, which itself is renowned as the primary agenda-setting news website in the United States, driving more traffic to individual stories than the likes of Facebook and Twitter combined.

Infowars owner Alex Jones is a nationally syndicated radio host whose broadcast appears on an ever-expanding list of big mainstream radio stations. Jones has been afforded feature profiles by the likes of Rolling Stone Magazine, who acknowledged his role as a pioneer in the media world.

Infowars.com is clearly a legitimate and important news website that features original content which routinely makes an impact and occasionally goes viral. And yet Google de-listed the website from its news aggregator on a whim with no explanation provided. Since Google and its owner Eric Schmidt are prominent financial contributors to the Obama campaign, we can only assume we were blacklisted for political reasons.

Whether you concur with our political stance or are rapidly against it, what can’t be argued is that we are a legitimate news outfit – but Google has arbitrarily banned us from appearing on their ‘news’ search results.

This is a clear example of how Google is already enforcing SOPA-like rules of its own choosing, without the need for any law to be passed by any legislative body.

 

In addition, while concerns rage about the state obtaining the power to shut down websites and remove web content with no recourse, Google is already following orders from the federal government in the majority of cases in removing videos from its You Tube platform, including takedowns on the grounds that the videos contain “government criticism”.

Google-owned You Tube has complied with thousands of requests worldwide to remove political protest videos that are clearly not in violation of any copyright or national security interests and do not constitute defamation.

The number of takedown orders received by Google from authorities based in the United States rose dramatically over the past year, with demands to remove information increasing by 70 per cent. Google complied in removing the material in 63% of the cases.

One such example was You Tube’s compliance with a request from the British government to censor footage of the British Constitution Group’s Lawful Rebellion protest, during which they attempted to civilly arrest Judge Michael Peake at Birkenhead county court.

Google has also targeted our own You Tube channel for termination on numerous occasions merely for posting legitimate news content, such as the Wikileaks Apache helicopter footage, which appears on hundreds of other You Tube channels.

Crucially, Google has for years censored its own search results subject to the mandates of different governments across the world. SOPA and PIPA are merely an effort to codify into US law what is already taking place in more authoritarian countries, with the willing participation of Google itself.

Many other web giants are also moving to censor the Internet, including VeriSign, who recently demanded the power to terminate websites deemed “abusive” with no legal oversight whatsoever.

Public wi-fi systems stationed in airports, train stations, libraries, schools, and workplaces also routinely censor political websites.

Who needs government to censor the Internet when large corporations are already doing it? Amidst all the anti-SOPA rage, we should not be so naive as to give the likes of Google a pass when considering the totality of threats posed to free speech on the world wide web.

We encourage people to at least be aware of alternatives to Google, search websites that will not enact SOPA-like censorship policies, such as StartPage.com. Watch a video below from November 2010 in which Alex Jones explains how Google is censoring the web – without the need for SOPA.

Ron Paul Tells CNN’s Bash Voters Should be “Furious” with Establishment Media

Following the media orchestrated circus earlier today in New Hampshire, Ron Paul terminated an interview with CNN correspondent Dana Bash after she said a voter was “turned off” by his decision to leave the diner in Manchester.

Before terminating the interview, Paul said the chaotic situation at a New Hampshire eatery was created by the media. “It says something about the media,” Paul responded. “Because you, the media, did that,” he said, pointing at Bash.

Following the interview, the New York Times tried to make it appear Paul’s patience with the establishment media has run out.

“This is the second time that Mr. Paul has walked out of an interview with CNN. He did it in December, albeit politely, when the political analyst Gloria Borger asked about his involvement with inflammatory newsletters,” writes Michael Barbaro for the Times.

It was later discovered that CNN edited the video to make it appear Paul had abruptly ended the interview. In fact, the interview had concluded, but Borger continued to ask Paul questions. CNN and the establishment media then said Paul had stormed off in order to make him appear angry and petulant.

Russian, French warships off Syria, Iran, US drones over Iranian coast

US, Russian French and British air and naval forces streamed to the Syrian and Iranian coasts over the weekend on guard for fresh developments at the two Middle East flashpoints.

The Russian carrier Admiral Kuznetsov anchored earlier than planned at Syria’s Tartus port on the Mediterranean Sunday, Jan. 8, arriving together with the destroyer Admiral Chabanenko and frigateYaroslav Mudry.
To counter this movement, France consigned an air defense destroyer Forbin to the waters off Tartus.

DEBKAfile’s military sources report a buildup in the last 48 hours of western naval forces opposite Iran in the Persian Gulf and Arabian Sea in readiness for Tehran to carry out its threat to close the Strait of Hormuz.

Britain has dispatched the HMS Daring, a Type 45 destroyer armed with new technology for shooting down missiles, to the Sea of Oman, due to arrive at the same time as the FrenchCharles de Gaulle aircraft carrier.

Our sources report too that Saturday, the giant RQ-4 Global Hawk UAV, took off from the USS Stenning aircraft carrier for surveillance over the coasts of Iran. The Stennis and its strike group are cruising in the Sea of Oman at the entrance to the Strait of Hormuz after Tehran announced it would not be allowed to cross through.
